INFORMATION REGARDING THE PROCESSING OF PERSONAL DATA

PURPOSE OF DATA PROCESSING

 

  • Management and maintenance of the website www.pgkart.com (hereinafter referred to as the ‘website’);
  • Handling of requests made by the Data Subject following completion of the appropriate form available on the website;
  • Protection of the security and functionality of the website;
  • Management of the access statistics to the website and its usage based on aggregate data. (The data could be used to ascertain responsibility in case of alleged computer crimes or actions against the website);

SOURCE OF PERSONAL DATA

Data is directly collected from the Data Subject through the website during access and navigation, and when using the contact form; 

MODALITIES OF PROCESSING PERSONAL DATA

  • The data is processed using IT tools by authorised personnel or using automated systems in the case of managing cookies and data collected during the user’s web surfing;
  • The data collected is protected by appropriate technical and organisational security measures;
  • Processing is carried out in accordance with the ‘Guidelines for Cookies and Other Tracking Tools’ of 10 June 2021 and issued by the Data Protection Authority (Garante per la protezione dei dati personali) – Italian Official Gazette No. 163 of 9 July 2021;
  • Any non-technical cookies are collected only with the freely, separately, and actively provided consent of the Data Subject;

LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

For website management and maintenance activities, as well as for the handling of requests from the Data Subject following the completion of the appropriate form available on the website;

  • Article 6 paragraph 1 b) processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;

For the purpose of protecting the security and functionality of the website (cookies known as First and third-party analytics cookies that are similar to technical cookies)

For other purposes (other types of non-technical cookies):

NATURE OF DATA PROVISION 

  • For the management and maintenance of the website, as well as activities aimed at protecting its security and functionality, providing data is mandatory and necessary for the user’s web surfing activities;
  • For the handling of contact requests through the dedicated section of the website, providing data is optional; failure to do so would make it impossible to submit requests through the dedicated form on the website;
  • Regarding activities associated with the collection of ‘non-technical’ cookies, providing data is optional. Failing to provide the necessary data and consent for their processing would prevent the utilisation of services for personalizing the experience and using services outside the site;

INFORMATION COLLECTED BY THE DATA CONTROLLER

The data collected concern information related to the user’s access to and navigation on the website and information communicated when using the contact form, including:

  • Personal information (first name, last name, date and place of birth, gender m/f);
  • Contact information (e-mail address, telephone number);
  • Services and products of interest;
  • Information freely provided by the Data Subject;
  • IP address;
  • Usage data;
  • Necessary cookies collected during navigation for website functionality;
  • Functionality cookies to facilitate the operation of services;
  • Statistical and anonymised performance cookies to assess the functionality of the website;
  • Cookies to interact with social media services accessible through the website;

Definition of cookies:

Cookies are text fragments that websites visited by the user or third-party sites place and store within a terminal device in the availability of the user with an active identification system.

Similar functions can be performed by other devices with so-called passive identification;

Technical cookies

 

These are employed to ‘carry out the transmission of a communication over an electronic communications
network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or by the user to provide such a service.’

First and third-party analytics cookies that are similar to technical cookies:

 

They are used anonymously to generate aggregate statistics and are related exclusively to the website or individual mobile application.

 

In the case of third-party cookies, they are not combined with other processing or transmitted to other third parties, except for web domains that can be traced back to the same publisher or business group.

 

Non-technical cookies

 

Cookies used to link specific, identified, or identifiable individuals to specific recurring actions or behavioural patterns in the use of functionalities offered for the purpose of grouping the various profiles within homogeneous clusters of different sizes. This allows the modulation of the service provision in an increasingly personalised manner, as well as the sending of messages through targeted advertising – in line with the preferences expressed by the user in the context of web surfing.

RECIPIENTS OF THE INFORMATION

  • Persons authorised to process the information, whether internal or external to the company;
  • IT service providers, such as, for example, hosting providers, IT companies, communication agencies.
    A complete list of recipients, with particular reference to those acting in their capacity as persons in charge of processing personal data is available in an updated form at the Data Controller’s offices;
  • Legal authorities upon request for the provision of information;

TRANSFER OF INFORMATION OUTSIDE THE EU

 

Personal data are not subject to transfer to foreign countries within the European Union or outside the EU.  Any transfer would, however, take place in compliance with Articles 45 and 46 of GDPR 679/16 EU;

STORAGE OF PERSONAL DATA

  • Data collected through the contact form on the website are kept for the duration necessary to achieve the purposes and for a further period of 10 years;
  • Session cookies (non-persistent) are kept only for the browsing session and are deleted automatically when the session is closed;
  • Persistent cookies are kept for a duration not exceeding 36 months and are subsequently deleted. However, by browsing the pages of the website, you may interact with sites managed by third parties that may create or modify permanent and profiling cookies.
  • Statistical cookies are stored for an unlimited time in an anonymous form;
  • Users can decide whether or not to accept cookies by using their browser settings. Public content can be accessed even if cookies are disabled. Disabling ‘third party’ cookies will not affect navigability under any circumstances. The setting can be defined specifically for different websites and web applications.  Furthermore, the best browsers allow you to define different settings for ‘owner’ and ‘third party’ cookies.  Links to the customisation pages of the most common browsers are provided in the section ‘Methods of data processing’;

RIGHTS OF THE DATA SUBJECT

 

The rights of the data subject (Articles 15 to 22) include:

  • access your personal data, pursuant to Art. 15 of the EU Regulation, in order to verify the processing of your personal data;
  • rectify your personal data, pursuant to Art. 16 of the EU Regulation, in the event that the accuracy of your personal data is contested;
  • complete your personal data, pursuant to art. 16 of the EU Regulation, in the event that the completeness of the data is contested;
  • delete, pursuant to Art. 17 of EU Reg., your personal data, unless it is necessary to comply with a legal obligation, or verify, exercise or defend a right in court, in the following cases:
    • the processing of such personal data is no longer necessary for the stated purposes;
    • the exercise of your right to object the processing has taken place, except where the legitimate interests of the data controller prevail over your interests or fundamental rights and freedoms;
    • the unlawfulness of the processing of your personal data has been established;
    • the existence of a legal obligation requiring the deletion of such personal data has been established;
  • limit the processing of your personal data, pursuant to Art. 18 of the EU Regulation, in the following cases:
    • the accuracy of such personal data is contested, even if only for the period of time necessary for the data controller to verify it;
    • the unlawfulness of the processing of your personal data has been established, together with your subsequent objection to delete such data;
    • there is no longer any need to process such personal data for the stated purposes, together with the simultaneous need to process them in order to verify, exercise or defend a legal claim;
    • the fact that you have exercised your right to object to the processing of your personal data, even if only for the period of time necessary for the data controller to verify it;
  • receive in a structured, commonly used and electronically readable format and, if necessary, have your personal data processed by the data controller by automated means transmitted to another data controller, pursuant to Article 20 of the EU Regulation;
  • object to the processing of your personal data, pursuant to Art. 21 of the EU Regulation, if the legitimate interests of the data controller prevail over your interests or fundamental rights and freedoms.

YOUR RIGHT TO LODGE A COMPLAINT

 

  • As a data subject, you may exercise your right to lodge a complaint with the Garante per la protezione dei dati personali (Italian Data Protection Authority), in the event of a dispute about compliance of the processing of your personal data by the data controller with the EU regulation, pursuant to art. 77 of the EU Regulation, by sending the appropriate form to the e-mail address  ‘protocollo@pec.gpdp.it
